01Who we are and what these terms cover

These Terms of Service govern your use of the Agenticert website, browser-local Agenticert Flow workspace, demonstrations, and related materials (the “Service”). The Service is provided by Agenticert (“Agenticert,” “we,” “us,” or “our”). Contact us at get-support@agenticert.com.

By using the Service, you agree to these terms to the extent permitted by applicable law. If you do not agree, please stop using it. Our Privacy Policy explains personal information handling; it is not a substitute for these terms. A separately agreed written contract may govern a particular service and takes priority for that service where it conflicts with these terms.

02Eligibility and organizational use

You must have the legal capacity to agree to these terms under the law that applies to you. If you use the Service on behalf of a company or other organization, you must have authority to act for that organization, and references to “you” include it. You are responsible for ensuring that your use and any information you provide are lawful.

The current Service does not provide a separately managed Agenticert user account, paid subscription, or cloud-synced workspace. Access restrictions imposed by the hosting platform may still apply. Any future paid or hosted features will require their own applicable arrangements before purchase or activation.

03Features and availability

Flow currently creates and edits infrastructure maps locally in your browser. Basic and Advanced are different presentations of the same map. Sample organizations, workflows, statuses, evidence, and data journeys are illustrative unless expressly identified otherwise. Product descriptions do not guarantee features beyond those expressly available in the Service or agreed in writing.

A map, profile, badge, framework, or displayed status does not itself establish that a system is secure, lawful, accurate, certified, independently audited, or continuously monitored. You must assess the underlying information and obtain appropriate professional advice for decisions that require it. The Service is not legal, medical, financial, or other regulated professional advice.

04Your maps, local storage, and backups

You retain your rights in the maps and other content you create. You must have the permissions needed to use any content you enter, import, export, or share. Merely saving a map locally does not transfer ownership to Agenticert or grant us a right to publish it.

The current workspace stores flow data in your browser’s local storage. We do not provide a server backup, account recovery, cross-device synchronization, or public map publishing for this workspace. Clearing site data, using a different browser or device, private browsing, storage limits, or device failure may make a map unavailable. Export copies you want to keep and protect your device and exported files.

Do not enter passwords, API keys, authentication tokens, or personal information you are not authorized to handle. A diagram represents what you document; it does not connect to, inspect, or change the real systems it depicts.

05Acceptable use

You may use the Service for lawful learning, evaluation, documentation, and authorized business activities. You must not:

• Use it to infringe another person’s privacy, intellectual property, or other rights.
• Upload malicious code, disrupt availability, bypass access controls, or attempt unauthorized access to the Service or another system.
• Misrepresent illustrative or self-declared information as independent verification, certification, endorsement, or guaranteed compliance.
• Impersonate another party or use Agenticert branding in a way that falsely suggests an affiliation.
• Use automated access in a way that unreasonably burdens the Service or defeats technical restrictions.

Authorized browser assistance and tools remain subject to the same permissions and restrictions as your own use.

06Our materials and your submissions

Agenticert and its licensors retain rights in the Service’s software, branding, design, and original materials, subject to any applicable open-source or third-party licenses. We give you a limited, non-exclusive permission to use the Service as provided for its intended purposes. These terms do not transfer ownership of our trademarks or give permission to claim our endorsement. Statutory rights and expressly stated licenses are unaffected.

If you voluntarily email us feedback or other material, you give us permission to use it as reasonably needed to respond, evaluate the suggestion, and provide the assistance you request. Do not send confidential information without an appropriate agreement. We do not acquire ownership of your submissions through these terms.

07Third-party services and links

The Service may link to third-party websites or rely on hosting, fonts, browser features, or other third-party technology. Their terms and privacy practices apply to their own services. Identifying a provider in a sample map does not mean we have a commercial relationship with it or that the workspace sends information to it. You are responsible for any external services you choose to use and for reviewing their relevant terms.

08Availability, changes, and ending use

We may update, limit, suspend, or discontinue features for maintenance, security, legal reasons, or product changes. Where reasonably practicable, we will give notice of a material change affecting ongoing use. You may stop using the Service at any time. Export local maps before clearing browser data or leaving a workspace you want to preserve.

We may restrict use that violates these terms or creates a material security or legal risk. Ending access does not give us control over copies stored on your device. Provisions that by their nature should continue, including ownership and applicable liability provisions, survive the end of use.

09Disclaimers and limits of liability

To the extent permitted by applicable law, the Service is provided “as is” and “as available,” without warranties of uninterrupted availability, fitness for a particular purpose, completeness, or error-free operation. We do not guarantee that using the Service will prevent incidents or satisfy a regulatory requirement.

To the extent permitted by applicable law, Agenticert is not liable for indirect or consequential loss, lost profits or business opportunities, or loss of locally stored maps resulting from your use of or inability to use the Service. You remain responsible for appropriate backups and for decisions based on your maps.

Nothing in these terms excludes or limits liability that cannot lawfully be excluded or limited, including any applicable liability for fraud, deliberate misconduct, or death or personal injury caused by negligence. Mandatory consumer protections and other non-waivable rights take priority over any conflicting wording.

10Questions, disputes, and applicable rights

If you have a concern, contact get-support@agenticert.com with enough detail for us to investigate and try to resolve it. This does not prevent you from using a regulator, court, or other remedy available under applicable law. These terms do not require arbitration or waive any mandatory right to bring a claim in a competent court. Any governing-law or venue provision in a separate written agreement applies only to that agreement, subject to mandatory law.

11Updates to these terms

We will post revised terms here and update the date above. Material changes will be brought to your attention through a prominent notice in the Service or another appropriate channel before they apply, where required. Changes apply prospectively; any acceptance required by law will be obtained. If a provision is unenforceable, the remainder continues to apply to the extent permitted by law.
